Terms of Service & Legal Disclosures
Last updated: June 2026. By using NeighborShare, you agree to the following terms.
1. Platform Role - No Liability
NeighborShare ("the Platform," "we," "us," or "our") acts solely as a technology intermediary connecting item owners ("Owners") and renters ("Renters"). We do not take possession of, inspect, verify, insure, or warrant any item listed on the Platform.
NeighborShare is not a party to any rental agreement between Owners and Renters. Any rental contract is formed directly between the Owner and Renter, and NeighborShare expressly disclaims all liability arising from or related to such agreements.
2. Hold Harmless Agreement
By creating an account or completing any transaction on NeighborShare, you agree to hold harmless, release, and forever discharge NeighborShare, its officers, directors, employees, agents, affiliates, and successors from any and all claims, demands, damages, losses, costs, and expenses - including legal fees - arising out of or related to:
- The use, misuse, or condition of any item rented through the Platform.
- Any personal injury, bodily harm, or death occurring during a rental period.
- Any loss, theft, or damage to property - whether the listed item or third-party property.
- Any dispute, disagreement, or legal claim between an Owner and a Renter.
- Any action or omission by another user of the Platform.
- The failure of any item to perform as expected or described.
3. Owner Responsibilities & Disclaimer
Owners represent and warrant that:
- They have the legal right to rent the listed item.
- The item is accurately described and is safe for its intended use.
- They carry any insurance they deem appropriate for the item.
- They understand NeighborShare does not provide insurance coverage for listed items.
NeighborShare is not responsible for any damage, loss, or injury caused by items listed on the Platform, nor for any failure of Renters to return items or pay for damages.
4. Renter Responsibilities & Disclaimer
Renters represent and warrant that:
- They will use rented items solely for their intended, lawful purpose.
- They will return items in the same condition received, accounting for normal wear.
- They assume full responsibility for any damage, loss, or theft of the item during the rental period.
- They possess any required licenses, skills, or certifications needed to operate the item (e.g., vehicles, power tools).
- They carry any personal liability or renter's insurance they deem appropriate.
NeighborShare is not responsible for any injury, property damage, or financial loss suffered by the Renter arising from their use of a rented item.
5. No Insurance Coverage
NeighborShare does not provide, arrange, or guarantee any insurance coverage of any kind - including but not limited to property insurance, liability insurance, or personal injury coverage - for any item, Owner, or Renter on the Platform.
Both Owners and Renters are strongly encouraged to consult with their own insurance providers to ensure adequate coverage before participating in any rental transaction.
6. Damage Deposits
A refundable damage deposit (10% of the rental total) is collected at checkout and held during the rental period. This deposit is intended to provide limited protection to Owners in the event of documented damage.
NeighborShare's role in deposit mediation is limited to reviewing submitted evidence (photos, condition logs, descriptions) and making a good-faith determination regarding deposit disposition. NeighborShare's mediation decision is final but does not constitute legal arbitration, and NeighborShare accepts no liability for losses exceeding the deposit amount.
7. Indemnification
You agree to indemnify, defend, and hold harmless NeighborShare and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Platform, or your participation in any rental transaction.
8. Limitation of Liability
To the fullest extent permitted by applicable law, NeighborShare's total liability to you for any claim arising from your use of the Platform shall not exceed the platform service fees paid by you in the three (3) months preceding the claim.
NeighborShare is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, regardless of the theory of liability.
9. Dispute Resolution
Any dispute between Owners and Renters is solely the responsibility of those parties. NeighborShare may offer good-faith mediation assistance but is not obligated to do so and is not bound by the outcome of any dispute between users.
Any dispute between you and NeighborShare shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and you waive any right to a jury trial.
10. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. You consent to personal jurisdiction in the state and federal courts located in Colorado for any claims not subject to arbitration.
11. Changes to These Terms
NeighborShare reserves the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will post the updated date at the top of this page.
